Purpose

Service Purpose

pitforge3D is an online software service enabling 3D visualization and geometric analysis workflows intended to support personal cockpit-building and immersive simulation projects. Because official dimensional references for military cockpits are often unavailable or incomplete, pitforge3D provides a scalable geometry viewing environment allowing users to inspect, measure, and (depending on plan) export personal-use geometry.

IMPORTANT: The Service is provided exclusively for private, non-commercial use and is not certified, approved, or intended for professional, industrial, regulated, military, or operational use.
SCOPE OF SERVICE: The purchase of a subscription or license grants access solely to the Software functionality. No intellectual property rights over user content or third-party content are transferred, licensed, or granted.

1. Scope

These Terms and Conditions of Sale ("TCS") govern all purchases of subscriptions and access to the pitforge3D software service (the "Service") made through the website pitforge3D.com. By subscribing to the Service, the user ("User") fully accepts these TCS without reservation. The Service is operated by MRCtech (the "Company").

2. Definitions

  • • Service: The pitforge3D SaaS platform, including its parser, viewer, export tools, and associated features.
  • • Subscription: A paid, time-based right of access to the Service.
  • • User: Any natural or legal person subscribing to the Service.
  • • Account: The personal user account enabling access to the Service.

3. Orders and Activation

Subscriptions become active immediately upon successful payment processing via Stripe. MRCtech reserves the right to refuse any order or subscription request at its sole discretion, without obligation to justify its decision.

4. Pricing

All prices displayed at checkout are final and expressed in the applicable currency. MRCtech may modify pricing at any time. Any price changes will not affect active subscriptions and will only apply at renewal.

5. Payment Terms

Payment must be made by credit or debit card via Stripe.

By providing payment information, the User represents and warrants that they are legally authorized to use the payment method.

Failure of payment may result in immediate suspension or termination of access to the Service.

6. Subscription Terms

Subscriptions are:

  • • Automatically renewed unless cancelled prior to renewal.
  • • Personal and linked to a single user account.
  • • Subject to valid and up-to-date payment information.

No refunds are granted.

No prorated refunds shall be issued for partial periods of use, unused time, or early termination by the User.

7. No Right of Withdrawal

Due to the digital nature of the Service and its immediate access upon payment, the User expressly waives any statutory right of withdrawal once the subscription is activated. This waiver is made in accordance with applicable digital content and digital service regulations.

8. Acceptable Use Policy

The User agrees to use the Service lawfully and in good faith. The following are strictly prohibited:

  • ✕ Any unlawful, illegal, or fraudulent use
  • ✕ Reverse engineering, decompilation, or circumvention
  • ✕ Automated scraping, mass extraction, or system abuse
  • ✕ Use for harmful, malicious, or dangerous purposes

9. License and Use Restrictions

The subscription grants a personal, non-exclusive, non-transferable, revocable license to access and use the Service. The Service is strictly limited to private, personal, and non-commercial use.

The following uses are strictly prohibited:

  • • Commercial exploitation
  • • Industrial applications
  • • Military or defense use
  • • Safety-critical systems
  • • Medical applications
  • • Aeronautical or operational systems

The Software is licensed, not sold.

This license is non-exclusive, non-transferable, and limited to the duration of the subscription.

Termination or expiration of the license does not grant any right to continue using exported files beyond the scope permitted under the Terms of Use.

10. Exporting and IP

All intellectual property rights in the Service, including software, algorithms, interfaces, designs, and infrastructure, remain the exclusive property of MRCtech.

Files generated or exported through the Service:

  • • Are licensed for personal use only
  • • May not be redistributed, sublicensed, sold, shared, published, or made available to third parties
  • • May not be integrated into commercial or professional workflows
  • • Remain subject to these restrictions even after the expiration, suspension, or termination of the User’s license or access to the Service, for any reason

11. Warranty Disclaimer

The Service is provided "as is" and "as available", without any warranties of any kind.

Disclaims all warranties:

  • • Accuracy & Reliability
  • • Fitness for purpose
  • • Non-infringement
  • • Operational continuity

Not certified for:

  • • Industrial use
  • • Safety-critical systems
  • • Defense systems
  • • Mission-critical environments

PitForge3D does not guarantee dimensional accuracy, structural integrity, or fitness for any real-world manufacturing, mechanical, or safety-critical application.

The Software outputs are not intended for use in real aircraft, vehicles, or certified equipment.

12. Limitation of Liability

To the maximum extent permitted by law:

MRCtech shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, business, or profits, system failures, or operational downtime.

MRCtech's total liability shall in all cases be limited to the amount paid by the User for the active subscription period.

13. Termination

MRCtech may terminate or suspend access to the Service immediately and without notice if the User violates these TCS, breaches usage restrictions, or engages in prohibited activities. No refund shall be granted in case of termination for cause.

For the avoidance of doubt, the expiration, suspension, or termination of the User’s license, whether due to expiry or termination for cause, shall not relieve the User of their obligations regarding MRCtech’s intellectual property. In particular, any downloaded files (including but not limited to STL files) remain strictly personal, non-transferable, and may not be reproduced, distributed, resold, shared, sublicensed, or otherwise exploited, in whole or in part, under any circumstances.

14. Data and Account Responsibility

The User is solely responsible for:

  • • The security of their account credentials
  • • All activities performed through their account
  • • The integrity and legality of uploaded files

MRCtech shall not be responsible for data loss resulting from User negligence.

15. Modifications of the Terms

MRCtech reserves the right to modify these TCS at any time. Users will be informed of material changes. Continued use of the Service after modification constitutes acceptance.

16. Governing Law and Jurisdiction

These TCS are governed by French law. Any dispute shall fall under the exclusive jurisdiction of the competent French courts.

17. Severability

If any provision of these TCS is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These TCS constitute the entire agreement between the User and MRCtech regarding the Service and supersede any prior agreements, communications, or understandings.
